Terms of Service
New Clients
In these terms of service, "Client" or "you" refers to the users of our website and "DiamondHTML" or "we" refers to DiamondHTML.com.
Quote Requests
When DiamondHTML receives a Client quote request, we will process it and review the job information as soon as possible and endeavour to provide our Clients with a quote offer within one (1) business day. We may need to email or contact Clients if insufficent information is provided and delays may occur due to the initial correspondence that takes place between Clients and DiamondHTML.
All information received by DiamondHTML from Clients through our quote request process or by email is strictly confidential, and remains the property of the Client, including any artwork or designs submitted. DiamondHTML do not share any information provided with any third party and Clients can be assured that we only use their information for the purposes of providing services as outlined on our website.
Quote Offers
Where the artwork has been provided: Quotes issued by DiamondHTML where artwork has been provided are final. The timeframe the quote is valid for, is included on the quote (usually 30 days from date of the quote).
Where the artwork has NOT been provided: All quotes are based on a standard HTML slice and code. Once we have reviewed the design, actual prices may vary and the Client will be notified should their be additional costs involved.
Reviews and Changes to Design/Artwork
Before DiamondHTML have started the project: Where there are changes/reviews requested by the Client which are significantly different to the initial artwork/design provided, DiamondHTML reserves the right to charge additional costs. Significant changes include extra items added to the design such as slideshows, galleries, menus, scripts, cms intergrations or other items outlined in Advanced Options. If the Client changes the design with no additional items required, the quoted price remains the same.
After DiamondHTML have started the project: DiamondHTML reserves the right to charge reasonable additional costs, for any changes to the artwork/design and/or extra added items such as slideshows, galleries, menus, scripts, cms intergration or other items outlined in Advanced Options, where the Client requests these changes after the project has been started by DiamondHTML.
W3C Validity and Cross Browser Compatibility
DiamondHTML guarantees that each site created is WC3 Valid and works across all standard browsers. In instances where an Ongoing Client provides specific functionality/scripts/code to DiamondHTML, it is the responsibility of the Ongoing Client or Providing Party to ensure the functionlities are WC3 compliant and cross browser compatible.
Payments
Once a client has accepted a quote offer, DiamondHTML issues payment requests via the PayPal secure site service. Payments are to be made in advance by Mastercard, Visa or with your PayPal account. Australian business customers with a valid ABN may be able to apply for 7 day term accounts (please contact us for more information). Where term accounts exceed $4000(AUD), clients will be asked for a 30% deposit. Refunds and credits are at the sole discretion of DiamondHTML and are only negotiated in circumstances where work is not delivered according to DiamondHTML's terms and conditions.
Turnaround Time
The turnaround time will begin when the Client has approved their quote offer from DiamondHTML by email or telephone and DiamondHTML has received confirmation from PayPal that payment has been made by the Client (or in the case of pre-approved Australian businesses, when the Client has approved their quote offer from DiamondHTML). Should DiamondHTML not be able to deliver the work in the timeframe required, an email will be sent or telephone call will be made, to the Client before the required time, giving sufficient notice that the job will be delayed. Should significant delays occur, a discount may be offered to the Client.
After Sales Support
We provide support for up to 14 days after the project has been completed. Our support is strictly limited to any additional fixes that may be required to your project's code. For any additional coding work not provided in our original quote, the Client will be charged at $50 per hour plus GST or at an alternate agreed fixed rate between both parties.
We DO NOT provide general I.T. support. We work hard to provide a quality service at a great cost, and if we spend all day answering general I.T. questions we would not get anything done - and that's not good for anyone.
Browser Support
As standard, we guarantee support for the following browsers: -
- Firefox 3+
- Safari 4+
- Chrome 4+
- Internet Explorer 7+
- Opera 10.5+
The reason we only guarantee our code to work with the above listed browsers is that there are a lot of different browsers out there. A majority of users use only the above browsers. Please see note below regarding Internet Explorer 6.
Internet Explorer 6
As of 1st September 2010, we have dropped standard support for Internet Explorer 6 (IE6). If you (or your client) requests support for IE6, we can still implement this, however there will be additional cost.
For those who do not wish to pay additional cost for IE6 support, we recommend you send us a designed webpage, asking users of your site to upgrade their browser if viewing in IE6 and we will include a free script to this page in your site build. If you do not provide such a page, we will use a pre-designed unbranded template with a list and link to the updated browsers.
Business Day
1 business day refers to 9am - 5pm Monday to Friday Australian Central Standard Time (or UTC +9:30).
Goods and Services Tax
As DiamondHTML is an Australian based business registered for Goods and Services Tax (GST), all Australian Clients will incur a 10% surcharge (GST) on their order to comply with Australian Tax Law. All international orders are tax free.
Backup
DiamondHTML deletes all project files after 10 business days of the job’s completion date. It is the responsibility of the Client to backup their work once they have received it.
Newsletter
When submitting your details to DiamondHTML, the Client agrees to subscribe to DiamondHTML's email newsletter and to receive promotional offers from time to time. DiamondHTML complies with anti-spam laws, and each newsletter has an unsubscribe link. The Client may choose to unsubscribe at any time and will not receive any further communications from DiamondHTML.
Confidentiality
Confidentiality is assured in respect to all works lodged with DiamondHTML. DiamondHTML will not sell, distribute, share or use a Client’s personal information, artworks or designs for any other means other than is necessary to deliver the Client’s requested project. DiamondHTML is happy to sign Confidentiality or Non-Disclosure Agreements if requested to do so.
Disputes and Grievances
Disputes or grievances can be lodged by submitting an enquiry form with detailed information about the dispute or grievance. DiamondHTML takes all disputes and grievances seriously and will do their best to respond and resolve the matter in a timely fashion.
Changes to Terms and Conditions
DiamondHTML reserves the right to change the terms and conditions at any time without notice. Our FAQ section also holds valuable information about our services and works in conjunction to these terms and conditions.
